The Marshal had been pursuing Kate for her crime of murdering Wayne for three years prior to Flight 815. He first caught her after she was turned in by her mother, Diane, but while he was driving with her in the car to the arraignment, he got into an accident as a strange horse from Kate's past stepped in the road.
Sometime during those three years, Kate repeatedly called the Marshal to try and explain why she was on the run (mitigating circumstances), which the Marshal took as her taunting him. Two years before Flight 815, Kate's childhood friend, Tom, was killed as she used his car to flee from a hospital in Iowa (where she had gone to visit her dying mother). The Marshal found Tom's toy plane in the car Tom died in, and placed it in a safety-deposit box in a New Mexico bank. Kate staged a bank robbery in order to retrieve the toy airplane, and eluded the Marshal's trap.
Kate ended up hiding on Ray Mullen's farm in Australia, where she was eventually turned in by Ray for a $23,000 reward. The Marshal apprehended Kate, and arranged to take her back to the US on Flight 815. At the airport, the Marshal boarded with a Halliburton case of four guns, and an ankle holstered gun.
During the crash, the Marshal suffers severe injuries which aren't able to be treated on the island. Sawyer attempts to euthanize the Marshal by shooting him in the heart, but misses. Jack is then forced to euthanize the Marshal.
He is buried in an area apart from the other graves. His grave is dug up later by Jack and Kate, in an effort to retrieve the key for the case.
